      H. F. No. 3664, relating to the military; expanding eligibility for the salary differential program for state employees ordered into active military service; permitting military personnel stationed outside Minnesota to use state parks without fee while home on leave; providing leave without pay to family members of soldiers wounded or killed while in active service, and for family members of deployed soldiers to attend send-off or homecoming ceremonies; establishing a policy statement supportive of military service; providing certain job protections for persons ordered into active military service; adding cross-references; directing institutions of higher education to provide credit for military training and experience for veterans; clarifying law governing renewal of occupational licenses and professional certifications during and following active military service; authorizing National Guard security guard employees to carry certain weapons; authorizing the placement of plaques honoring certain veterans in the Court of Honor.

      I have exercised a line item veto of the following appropriations:

 

      1.    Page 23, lines 23.12 - 23.25: A $1,000,000 grant in FY 2008 for the NorthStar Quality Improvement and Rating system. The appropriation for the NorthStar Quality Improvement and Rating System has been line‑item vetoed. This system considers input driven indicators, rather than measuring meaningful outcomes. For the past ten years, the state has been moving to an accountability system that measures results and outcomes in K-12 public schools. If the objective for quality child care is to ensure that young children are ready for kindergarten, then a child care rating system should be aligned with the K-12 accountability system. An input-driven rating system is not the best way to provide parents with meaningful results regarding the quality of the child care facility.

 

Therefore, I am directing the Departments of Education and Human Services to collectively review the concept of a Quality Rating System, and to make recommendations on what would be the necessary components to better align kindergarten readiness of a child to the rating of a child care facility.

 

      2.    Page 103, lines 103.4 - 103.19: A $37,000 appropriation in Chapter No. 282, Article 14, Section 2 to the Legislative Coordinating Commission for improving legislative effectiveness and financing a legislator's international forum. These are worthy activities, but they should be funded from the Legislature's existing appropriations or its unexpended balance of $4.8 million. In the end, real reform will be achieved when the Legislature adopts my performance pay for politicians' proposal, not from additional self-funding.

 

      3.    Page 255, lines 255.12 - 255.18: A $5,000 increase in FY 2006 and 2007 for the Board of Chiropractic Examiners in Article 22, Section 5, Subdivision 2. This appropriation duplicates funding included in separate legislation (Chapter No. 267) which I have already signed into law.

NOTICE FROM THE CHIEF CLERK

 

      Chapter No. 88, H. F. No. 2461, the omnibus transportation finance bill, was vetoed by the Governor on May 19, 2005.

 

      As indicated in the veto message from the Governor, Chapter No. 88 contains a proposed constitutional amendment to be presented to the people at the 2006 general election.

      Chapter No. 88, article 3, sections 9 and 10, read as follows:

 

      "Sec. 9. CONSTITUTIONAL AMENDMENT PROPOSED.

 

      An amendment to the Minnesota Constitution is proposed to the people. If the amendment is adopted, two sections will be added to article XIV to read:

 

      Sec. 12. Beginning with the fiscal year starting July 1, 2007, 63.75 percent of the revenue from a tax imposed by the state on the sale of a new or used motor vehicle must be apportioned for the transportation purposes described in section 13, then the revenue apportioned for transportation purposes must be increased by ten percent for each subsequent fiscal year through June 30, 2011, and then the revenue must be apportioned 100 percent for transportation purposes after June 30, 2011.

 

      Sec. 13. The revenue apportioned in section 12 must be allocated for the following transportation purposes: not more than 60 percent must be deposited in the highway user tax distribution fund, and not less than 40 percent must be deposited in a fund dedicated solely to public transit assistance as defined by law.

 

      Sec. 10. SUBMISSION TO VOTERS.

 

      The constitutional amendment proposed in section 12 must be presented to the people at the 2006 general election. The question submitted must be:

 

      "Shall the Minnesota Constitution be amended to dedicate revenue from a tax on the sale of new and used motor vehicles over a five-year period, so that after June 30, 2011, all of the revenue is dedicated at least 40 percent for public transit assistance and not more than 60 percent for highway purposes?
