A House resolution designating March 1, 2010, as
"Canada Day at the Capitol."
Whereas,
the United States and Canada share not only a 5,500-mile border, which is the
world's longest unmilitarized border, but also common ideals and democratic
principles; and
Whereas, the
relationship between Canada and the United States is unique in the world, and
the two countries have a shared prosperity fostered by two-way investment and
jobs; and
Whereas,
relations between Canada and the United States span more than two centuries,
and the two countries have developed one of the most successful international
relationships in the modern world; and
Whereas, Canada
and the United States have the largest and most comprehensive trade
relationship in the world; and
Whereas,
the relationship between Canada and Minnesota is equally strong, combining a
complex and growing network of social, economic, and even familial ties; and
Whereas,
7.1 million American jobs were dependent on trade with Canada in 2007,
including over 141,000 jobs in Minnesota; and
Whereas,
the United States is Canada's largest export market, with the United States
importing $339 billion in goods from Canada in 2008; and
Whereas,
some of Canada's top imported goods from the United States include vehicles,
reactors and boilers, electrical machinery, fuels and oils, plastic, optical
and medical instruments, aircraft, iron, steel, fruits and nuts, baking-related
goods, vegetables, beef, pork, and poultry; and
Whereas,
the United States and Canada also have a very special and important military
and defense relationship with one another; and
Whereas,
Canada and the United States are both members of the North Atlantic Treaty
Organization (NATO) and our forces have fought alongside each other in most
major conflicts since World War II, including the Korean War, the Gulf War, the
Kosovo War, and, most recently, the war in Afghanistan; and
Whereas, since
September 11, 2001, our strong military relationship with Canada has helped to
keep the United States safe from further terrorist attacks, and Canada is now,
more than ever, a key military ally of the United States; and
Whereas,
2010 marks the 40th anniversary of the establishment of Canada's Consulate
General in Minnesota; Now, Therefore,
Be It
Resolved by the House of Representatives of the
State of Minnesota that it welcomes Consul General Martin Loken and designates
March 1, 2010, as "Canada Day at the Capitol."
Be It Further
Resolved that the Chief Clerk of the House
of Representatives is directed to prepare an enrolled copy of this resolution,
to be authenticated by his signature and that of the Speaker, and transmit it
to Consul General Martin Loken.

DEMOLITION WASTE FROM STATE BUILDINGS; REQUIREMENT.
The
commissioner of administration shall require in contracts for the construction,
renovation, or demolition of a state building that the contractor and any
subcontractor must divert from deposit in a landfill and must recycle at least
50 percent of the nonhazardous construction and demolition waste, measured by
tonnage or volume, produced by the project or demonstrate that the waste was
delivered to construction and demolition waste recycling facilities that
maintain a 50 percent annual recycling rate.
This requirement applies to state building construction, renovation, or
demolition projects receiving funding from the bond proceeds fund after January
1, 2010, provided that:
(1) the
project is located within 40 miles of a construction and demolition waste
recycling facility that meets the requirements of this section and can process
the applicable building materials; and
(2) for construction and renovation projects, funding from the
bond proceeds fund is $5,000,000 or more.
EFFECTIVE DATE.
This section is effective the day following final enactment."

allow judges to order electronic monitoring for domestic abuse offenders on

629.72, subdivision 2a, is amended to read:
Subd. 2a. Electronic monitoring;
condition of pretrial release. (a)
Until the commissioner of corrections has adopted standards governing
electronic monitoring devices used to protect victims of domestic abuse, the
court, as a condition of release, may not order a person arrested for a crime
described in section 609.135, subdivision 5a, paragraph (b), to use an
electronic monitoring device to protect a victim's safety.
(b)
Notwithstanding paragraph (a), The chief judge of a
judicial district conducting a pilot project under this paragraph shall convene
an advisory group consisting of representatives from law enforcement,
prosecutors, defense attorneys, court administrators, judges, and battered
women's organizations. A judicial
district must develop standards for the use and evaluation of electronic
monitoring devices to protect victims of domestic abuse and must ensure that
release of electronic monitoring data is used only to protect victims. The district courts in the Tenth a judicial
district may establish a pilot project to allow courts in the district to order,
as a condition of a release, a person arrested on a charge of a crime described
in section 609.135, subdivision 5a, paragraph (b), to use an
electronic monitoring device to protect the victim's safety. courts judicial district shall
make data from the pilot project on the use of electronic monitoring
devices to protect a victim's safety in the Tenth Judicial District
available to the commissioner of corrections to evaluate and to aid in
development of standards for the use of devices to protect victims of domestic
abuse. A district shall report
information on the pilot project to the state court administrator's office as
directed by that office. By January 15,
2013, the state court administrator shall report by electronic means to the
chairs and ranking minority members of the senate and house committees having
jurisdiction over criminal justice policy on the experience of any pilot
projects established under this paragraph.
SUNSET.
The amendments to this section expire on January 15, 2013."

required under paragraph (c) shall include, at a minimum, a description of the
actions, if any, taken by the manufacturer to do the following:
(1) provide for the safe collection and proper disposal of
sharps;
(2) educate consumers about safe management and collection
opportunities; and
(3) support efforts by retailers, pharmaceutical distributors,
local governments, health care organizations, public health officers, solid
waste service providers, and other groups with interest in protecting public
health and safety through the sale, collection, and proper disposal of sharps.
(e) Sharps
manufacturers must post and maintain a copy of the plans required under
paragraph (c) on the manufacturer's Web site.
(f) The
commissioner of the Pollution Control Agency must post and maintain copies of
plans submitted by manufacturers on the Pollution Control Agency Web site.
(g) This
subdivision does not apply to any medication provided in a hypodermic needle,
pen needle, intravenous needle, or any other similar device that employs a
mechanism or method to sheath, shield, or render nonhazardous the needle or
similar device after use so as to substantially eliminate the possibility of an
unintended or accidental needle stick."
